For ease of reference, we will refer to Halston-tire.com as “Halston,” “we,” “us,” or “our.” As with any shopping experience, transactions on Halston are subject to terms and conditions. If you purchase a product from our site, these Terms apply to you and Halston. The Privacy Policy and Terms of Use also apply. You must be at least 18 years of age to order from Halston-tire.com. These general terms and conditions of sale are intended to regulate the contractual relations between our company and you, as an end customer, user of the Halston-tire.com website. By making a purchase on our website, you accept these conditions, which define the framework of sales as well as the rights and obligations arising therefrom. Article 3: Order

Orders are only confirmed after receiving written confirmation from the site, by sending a confirmation email to the buyer, followed by sending an electronic invoice in printable format.

Article 4: Rates and invoicing

The prices displayed on the site are established according to the economic conditions in force. No additional costs will be required from the Buyer. The prices including all taxes are based on the rates displayed by the Seller. The promotional offers presented on the site or broadcast on other platforms (partners, emails, newsletters, etc.) are valid during the specified period (date and time) and reserved for orders placed on the Site. Some offers may require the use of a promotional code, which cannot be combined or refunded. In order to benefit from the offer, the customer must enter the promotional code in the space provided for this purpose before confirming their order. Any reduction applied to an invoice, whatever the reason, will be deducted from our turnover, thus resulting in a proportional reduction in the amount of VAT due. An invoice will be issued for each delivery, even in the event of partial delivery. This invoice will be accessible on the site and can be printed from the customer’s secure account (in the “My Account” section). The customer may also request a copy of their invoice by mail or email.

Article 5: Delivery and deadlines

All purchases made on Halston benefit from hand delivery, with no minimum purchase amount. This is done through a professional logistics company (La Poste, DHL, Fedex, TNT, etc.). The customer will not have to pay any handling fees. As soon as the order is validated, our team will immediately take care of the preparations on the same day of purchase, if the order is placed before noon. After this date, the preparations will be postponed to the next day. It should be noted that in some cases, Halston may contact the customer by email to receive additional information in order to properly prepare their order. In particular, if the delivery address is missing or if it is incorrect. This may delay the sending of the package until receipt of the return and confirmation from the customer.

Our delivery times are generally 5 to 10 working days, depending on the delivery address provided by the customer, as well as the specific protocols imposed by the logistics company (disinfection, package processing, etc.). The customer will receive a tracking number for their package from us 1 to 2 days after the order has been sent by the logistics company. Halston-tire.com undertakes to inform the customer by email or telephone in the event of a delivery delay due to unforeseen circumstances. In the event of loss of the package, the customer must inform us immediately by email. An investigation will be carried out with the carrier in the following days. Once the loss of the order is confirmed by the carrier, the customer will receive a full refund of their purchase or may choose to have their order reshipped, according to their preferences.

In the event of damage or non-delivery, it is the customer’s responsibility to formulate specific reservations on the delivery receipt in the presence of the delivery person and the representative of the logistics company. He must then confirm these reservations (by mail or email) within 7 days of receiving his goods. If these reservations are not made, the seller cannot be held responsible under any circumstances, and no compensation will be granted.

Article 6: Delay in delivery

A delivery delay may occur in the following situations:

Order Validation: In order to protect our customers against possible banking fraud, all our orders are fully verified. We may ask the Buyer for additional information before validating their order. In order to avoid any fraudulent use of their credit card or the payment method they use, we may ask them by email for an identity document or proof of address. If these supporting documents are not sent to us, the order will be cancelled, and the funds taken will be automatically refunded to the customer on the payment method they used to place the order.

Availability: Our teams strive to provide real-time information regarding the availability of our products. However, unforeseen situations may arise despite our efforts. In this case, Halston-tire.com will send a message to the customer to inform them of the status of their order.

Cancellation of order: In the event of non-delivery within 14 days following validation of the order, the order will be cancelled and the Buyer will be fully reimbursed for their purchase.

Article 7: Property Rights

All descriptions and images published on the site are protected by copyright and intellectual property rights, reserved worldwide. It is therefore strictly forbidden to reproduce them, even partially, without our formal agreement. Any creation of hypertext links to our site without our authorization is also prohibited.

Article 8: Payment terms and security of your purchases

Payment for an order must be made before the product is shipped. We only accept one-time payments and do not offer split payments. In the event of non-payment of an order placed on our site, the order cannot be validated.

Halston does not store your bank details in any way, as only the Stripe payment processor that we use has access to them.

Article 9: Receipt, Return and Refund

Without prejudice to the steps to be taken with the carrier, any complaint concerning an apparent defect in the product must be communicated upon receipt of the order. To return a product, the Buyer must first contact our customer service available 5/7 days from 8 a.m. to 5 p.m. by email at the following address: support@halston-tire.com. Customer service will provide the instructions to follow and send them a return form, the procedure to follow and the return address for the package, which may be one of our warehouses in the United States, Europe or Asia. It is mandatory that the Buyer return the product in its original condition, without modification or damage, and with all the elements included in their order (accessories, instructions, etc.). The product must not have been used, as prior use would render the product unusable. The package must be properly packaged. Otherwise, our teams reserve the right to refuse the return of the product. After sending the package, the Buyer must provide our customer service with the tracking number of the package so that we can track the return of the package on our side. The return costs will be borne by the Buyer. Once the package has been returned to one of our premises, our refund service will send you a confirmation email. You will then be fully refunded for your purchase on the payment method you used to place your order, via bank transfer, or any other payment method agreed with the customer. The refund is effective 5 to 10 days after receipt of the product. Before returning the product, we invite the customer to take clear photos of each item that was sent to them in order to prove the condition of the product before sending it. This will allow us to note the condition of the product and, if there is damage, to prove that the customer is not responsible for it and will benefit from a full refund. In the event of damage inflicted by the customer on the product, Halston Tire will make a report to the customer and assess the extent of the damage and agree with the customer on the amount of the damage so that it can be deducted, following a mutual agreement between Halston and the customer, from the amount of the reimbursement.

Article 10: Guarantees – Withdrawals – Cancellation

The products delivered by Halston-tire.com are covered by a guarantee from the Seller in accordance with the legal provisions of the Civil Code and the Consumer Code. The customer benefits from a 14-day money-back guarantee and can exercise his right of withdrawal to be reimbursed. However, he must notify our customer service by email at support@halston-tire.com of his intention to withdraw. We will then confirm the steps to follow to return the product (Read Article 9) and he will receive a full refund of his purchase once the product has been returned. The customer can also decide to cancel his order under certain conditions. In order for the order to be cancelled, the request must necessarily be made by email to support@halston-tire.com before the package is sent. Once the package has been sent, Halston cannot intervene to repatriate it. The Buyer must then receive the package and exercise his right of withdrawal previously stated. Under the legal guarantee of conformity, the consumer may, in the event of a defect or other problem noted on the product upon receipt, choose between replacing the product or refunding the purchase. He must prove a lack of conformity of the product during the 14 days of the money-back guarantee following delivery by sending photos or videos following the instructions given by our technical department.

Unless otherwise indicated, the delivered product is covered by the seller’s warranty in accordance with the public order rules of the Civil Code. The warranty does not apply to defects and deterioration caused by wear and tear, an external accident (such as poor maintenance, shock, etc.), or an installation that does not comply with the instructions and recommendations provided by the manufacturer. The return costs under the warranty will be borne by the Buyer. The shipping costs following the replacement of the product will be borne by the Seller for shipments to the United States and by the Buyer for other countries.

Article 11: Obligations of the Seller and the Buyer

Halston-tire.com undertakes to provide the Customer with the technical notice with all the necessary explanations for the installation of the purchased product, at the same time as the delivery of said product. The Seller reserves the right, in the event of unavailability of certain components or software, to provide components or software offering equivalent performance (in accordance with their technical notice). The Seller does not guarantee the absence of design or production defects in its products. Consequently, the customer will retain his direct warranty rights with the manufacturer of the product.

The customer is responsible for determining his own needs and choosing his products with full knowledge of the facts. It is his duty to pay for his purchase and the associated costs within the specified time. He must also ensure that he installs his product in accordance with the instructions provided in the technical notice provided by the Seller.

Article 12: Suspension of obligations in the event of force majeure

In addition to the elements usually retained by American case law, the Seller’s obligations may be suspended in situations beyond its control and preventing the fulfillment of the conditions of the contract, such as: a fire, a storm, a flood, etc. As soon as the Seller notices such a problem, it must inform the customer as soon as possible in order to be able to perform the promised service as soon as possible. Once the cause of the suspension of its obligations has been resolved, the Seller must inform the Buyer of their resumption.

Article 13: Disputes

In the event of a dispute, our customer service can be reached at the following address: support@halston-tire.com. In accordance with the Consumer Code, any dispute may be brought before a competent court, which facilitates the independent out-of-court settlement of online disputes between consumers and professionals.

The Law applies only to relations between the Seller and the Buyer, even if the latter is located abroad, his order is delivered from abroad or the payment is made in a country other than the United States. The parties must seek a possible amicable agreement before any dispute. Any dispute relating to this sale, even in the event of a guarantee or multiple defendants, will be under the exclusive jurisdiction of American case law.
